Promotion Start/Close Date The Promotion starts at 12.01am (AEDST) on Monday, 02 November 2020 and closes at 23.59pm (AEDST) on Thursday, 31 December 2020 (“Promotional Period”).
No entries will be accepted after this time.
Entry Details
Method of Entry To enter: LatitudePay customers will enter the competition when they make any single transaction using their LatitudePay account within the Promotional Period.

An entrant will receive one (1) automatic entry for each transaction made using their LatitudePay account within the Promotional Period.

Exclusions to Entry A. The winning entrant must not be in default of their LatitudePay account at the time of claiming a prize and may, in the absolute discretion of the Promoter, be deemed as a forfeiture of any right to a prize.
B. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or its related bodies corporate or of the agencies or organisations associated with this Promotion, are ineligible to enter.
Draw Details There will be Two (2) separate draws conducted during the Promotion Period, Draw A and Draw B. Entries close for each draw at 11:59pm on the dates specified in the table below. All draws will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway Erina NSW 2250 at 11:00am on the dates specified in the table below. All times indicated are AEDST unless specified otherwise. Entries in each draw will NOT be entered into any subsequent draws. For clarity, entries in Draw A are not eligible as entries in Draw B, and entries in Draw B are not eligible as entries in Draw A.

Prize Details The first valid entry drawn in Draw A will win the major prize of Visa Gift Cards to the value of $10,000.

The next twenty nine (29) valid entries drawn in Draw A will each win the minor prize of a Visa Gift Card to the value of $250.

The first valid entry drawn in Draw B will win the major prize of Visa Gift Cards to the value of $10,000.

The thirty one (31) valid entries drawn in Draw B will each win the minor prize of a Visa Gift Card to the value of $250.

Prize Terms Any ancillary costs associated with redeeming a Visa Gift Card are not included. Any unused balance of a Visa Gift Card will not be awarded as cash.
Redemption of a Visa Gift Card is subject to any terms and conditions of the issuer including those specified on the Visa Gift Card.
Total Prize Pool The total prize pool value is AUD $35,000.
Notification, Publication, Verification, Delivery
Notification/Publication of Winner The winners will be notified in writing within two (2) business days of the relevant draw via email which will include a link for customers to confirm and accept their prize.

In the event of any SA winners of prizes valued at over $250, they will have their name published in The Advertiser on the dates indicated in the table above.
In the event of any ACT winners, they will have their name published on the LatitudePay website https://latitudepay.com/offers/be-in-to-win on the dates indicated in the table above.

Verification Requirements Entrants and winners of a prize draw may, at the discretion of the Promoter, be required to:
  1. Provide proof of identity, age and residency to verify their entry (Proof of Identity). Identification considered suitable for verification is at the Promoter’s discretion;
  2. Agree to be available for specific dates/times/locations; and/or
  3. If an entrant/winner fails to provide Proof of Identity, signed Waiver and Release Agreement or agree availability to locations, dates and times stipulated by the Promoter, their entry/prize claim will be deemed invalid at the Promoter’s discretion.
Delivery Date/Prize Claim Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

The Promoter is not liable for any part of the prize that has been lost, stolen, damaged or tampered with in any way after it has been dispatched.

Unclaimed Prize Draws A draw for any unclaimed prizes may take place on 14/04/2021 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw via email which will include a link for customers to confirm and accept their prize.

In the event of any SA winners of prizes valued at over $250, they will have their name published in The Advertiser on 28/04/2021. In the event of any ACT winners, they will have their name published on the LatitudePay website https://latitudepay.com/offers/be-in-to-win, on 28/04/2021.

Terms & Conditions

  1. Participation in the Promotion constitutes acceptance of these Terms and Conditions (including the Schedule). Any capitalised terms used in these Terms and Conditions have the meaning given in the Schedule, except where stated otherwise.
  2. The competition will be advertised on the LatitudePay website, social media and email, as soon as permit is issued.
  3. Entry
  4. Entry to Promotion is open to Australian residents aged 18 years or older who are LatitudePay account holders.
  5. The Promotion will be conducted during the Promotional Period. To enter, entrants must comply with the Entry Details during the Promotion Period. Any entry must be made personally. No entry made by a third party on behalf of an entrant will be valid.
  6. Entries must be submitted in accordance with the Entry Details. Once submitted, entries will not be capable of alteration or deletion.
  7. Entries must be received by the Promoter during the Promotional Period. Online and other electronic entries are deemed received at the time of receipt by the Promoter into the relevant database. The Promoter accepts no responsibility for any late, lost or misdirected entries.
  8. The Promoter reserves the right to verify identity as per the Verification Requirements. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  9. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity or other defamatory statements.
    The Promoter reserves the right to disqualify any entrant or winner, who breaches these Terms and Conditions, tampers with the entry process, engages unlawful, fraudulent, misleading or deceptive behaviour (including any behaviour calculated to jeopardise the fair and proper conduct of
  10. the promotion), or damages the goodwill or reputation of the Promoter. Inaudible, illegible, incomprehensible and incomplete entries will also be deemed invalid.

    Prizes
  11. The prize is specified in the Prize Details, and subject to Prize Terms (including those specified below). Total prize pool is also specified in the Schedule.
  12. Prize value is based upon the recommended retail price at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the final prize redemption date.
  13. All costs associated with a prize, which are not expressly included in the Schedule as an element of the prize, are the responsibility of the winner.
  14. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to any directions from a regulatory authority.
  15. It is a condition of accepting a prize that the winner must comply with all conditions of use of the prize and any other requirements, or terms, imposed by the supplier of the prize.
  16. The prize is non-refundable, and any unused portion of the prize, is non-transferable or exchangeable or redeemable for cash, unless otherwise specified. No credit will be loaded onto the winner’s Qualifying Product account.
  17. Determination and Notification
  18. The Winners will be notified, and their names and State/Territory of residence will be published as per the Schedule. The Promoter and the companies/agencies associated with the Promotion may also publish the name and State/Territory of residence of the Winner on their website(s) and in trade publications.
  19. The prize will be awarded to the person named in the valid entry. In the event of any dispute, the prize will be awarded to the account holder of the entry mechanism used to submit the entry.
  20. Should an entrant’s contact details change during the Promotional Period, it is the entrant’s sole responsibility to notify the Promoter.
  21. Claiming Prizes
  22. The prizes must be claimed in accordance with instructions set out in the Schedule. If a prize is not accepted in accordance with the schedule, the Promoter reserves the right to distribute the unclaimed prizes in accordance with the Unclaimed Prize Draw details specified in the Schedule, subject to any directions given by relevant authorities.
  23. Other Terms
  24. The winner agrees to participate, as reasonably required, in media editorial requests relating to the prize, including being interviewed, photographed and filmed.
  25. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with any media or advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  26. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  27. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to properly proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, inclement weather conditions, acts of God, civil unrest, strike, war, act of terrorism, computer virus, fraud, tampering, unauthorised intervention, or technical failure, the Promoter may in its absolute discretion cancel, terminate, modify or suspend the competition, subject to direction of the relevant authorities.
  28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  30. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.latitudefinancial.com.au/privacy/ In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia. If the entrant no longer consents to their details being used, or wish to update, modify or delete their details, the entrant should contact the Promoter.
